Terms of Service
Last updated November 4, 2026
These terms are the agreement between you and Bear Software, registered with the Dutch Chamber of Commerce (KvK) under number 42017540, VAT number NL005437235B03, Marene 16, 4007 NP Tiel, the Netherlands (“we”, “us”), which runs Windowsites. They apply when you activate a plan. In short: we build and host a website for your business, you pay a fixed price per month or year, it renews automatically until you cancel, and you can cancel online at any time. Version 2026-11.
1. Who can use Windowsites
Windowsites is a service for businesses. By activating a plan you confirm that you are at least 18, that you act on behalf of a business, and that you are allowed to agree to these terms for that business. You are responsible for keeping your login email secure; anyone who can open the login links we send to it can edit your website.
2. Free sample sites
We may build a sample website for your business from public information about it (for example your Google Business Profile) and send you a link. A sample costs nothing and creates no obligation. It is marked as a sample, is not indexed by search engines and is taken offline after a limited time. If you would rather not hear from us, use the unsubscribe link in our email or reply to it, and we will stop.
3. What you get
With an active plan we:
- host your website, with a secure (https) connection, on our own address or on your own domain;
- give you an online account where you can change texts, photos, opening hours, pages, colors and layout yourself;
- register a domain name for you if you choose one at checkout (see section 7);
- keep the site running and up to date with security fixes.
Optional extras, such as email mailboxes or add-on modules, are priced separately and shown before you turn them on. We may improve or change features over time; we will not remove a core part of the service you pay for without notice (see section 13).
4. Price, payment and automatic renewal
Your plan renews automatically at the end of each billing period (every month, or every year if you chose annual billing) at the price shown when you signed up, plus applicable sales tax, until you cancel. The current price is $79 per month or $790 per year. The amount and billing frequency are shown at checkout, next to a separate checkbox where you agree to the automatic renewal, and again in the confirmation email we send after you sign up.
- We charge in advance for each billing period, through our payment processor Stripe, to the payment method you provide. We never see or store your full card number.
- If you joined with a free first month (for example through a referral), your first charge happens when the free month ends, unless you cancel before then.
- Prices exclude sales tax and similar taxes, which we add where required.
- If a payment fails, Stripe will retry and we will email you. If the plan is still unpaid 14 days after the first failed payment, we may take the site offline until it is paid.
5. How to cancel
You can cancel at any time, online, in your account: log in, open “Plan and invoices” and choose to cancel. You can also cancel by replying to any of our emails or by writing to berend@bearsoftware.nl; we will process that within one business day and confirm it by email.
Cancellation takes effect at the end of the billing period you already paid for, and you will not be charged again. Until then your site stays online. We do not give refunds for the unused part of a period or for setup fees, except where the law requires it or where we made a billing mistake.
6. Price changes
We may change prices for future periods. We will email you at least 30 days before a new price applies to you, with the new amount and the date it starts. If you do not want to continue, you can cancel before that date and you will not pay the new price.
7. Domain names
If we register a domain for you, it is registered in your name and is yours. While your plan is active we renew it and manage its settings for you. If you cancel, or ask us at any time, we will give you what you need to move the domain to a registrar of your choice (such as the transfer code). After your plan ends we stop renewing it, so make sure you transfer it before it expires if you want to keep it. If you bring your own domain, you stay responsible for it and for its renewal.
8. Your content
Everything you or your business provide (texts, photos, logos, business details) stays yours. You give us permission to host, copy, resize, display and adapt it as needed to run your website and the service, for as long as your site is with us.
We write the first version of your site from public information about your business, partly with the help of AI. Please check your site and correct anything that is wrong before and after it goes live, especially claims about licenses, insurance, warranties, prices, service areas and opening hours. You are responsible for what your published site says about your business.
You promise that your content:
- is accurate and does not mislead customers;
- does not include fake reviews or testimonials, or reviews you paid for without saying so;
- does not infringe anyone else's copyright, trademark or privacy;
- is not illegal, hateful, sexually explicit, or meant to deceive or harm people (for example phishing or malware).
We may remove content, or take a site offline, that breaks these rules or that we are legally required to remove. We will tell you why unless the law does not allow it.
9. Photos and third-party material
Your site may show stock photos from Unsplash, under the Unsplash License and credited to the photographer, and information from your Google Business Profile, such as your rating. You may use these on your Windowsites site. If you want to use stock photos elsewhere, check the license yourself.
10. Our service and software
The templates, design system, editor and software behind Windowsites belong to us. Your plan gives you the right to use them for your own website while the plan is active. You may not copy, resell or reverse-engineer the service, or use it to build a competing product.
11. Availability and support
We work hard to keep your site fast and online, but we cannot promise that it will never be interrupted, for example during maintenance or because a hosting provider has an outage. If something does not work, report it through the link in your emails or by replying to one, and we will help.
12. Liability
The service is provided “as is”. To the fullest extent the law allows: (a) we are not liable for indirect or consequential losses, such as lost profits, lost customers or lost data; and (b) our total liability for any claim related to the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as for fraud or intentional misconduct.
You will cover our reasonable costs if a third party makes a claim against us because of content you put on your site or because you broke these terms.
13. Changes to these terms
We may update these terms. For changes that matter to you, we will email you at least 30 days before they apply, and you can cancel before then if you do not agree. The version you agreed to is recorded with your account.
14. When we may end the service
We may suspend or end your plan if you seriously or repeatedly break these terms, do not pay (see section 4), or if we stop offering Windowsites. Unless you broke these terms, we will give you at least 30 days' notice, help you move your domain, and refund any period you paid for but will not get.
When a plan ends, the site goes offline. We keep its content so you can restart it later; you can ask us for a copy of your texts and photos, or to delete everything, at any time.
15. Law and disputes
These terms are governed by the laws of the Netherlands, without regard to its conflict-of-law rules, and the UN Convention on Contracts for the International Sale of Goods does not apply. Before going to court, please contact us so we can try to solve the problem together. Disputes are decided by the competent court in the Netherlands, unless the law of your state gives you the right to bring a claim where you are.
