Partner terms

1. Who

This program is run by Bear Software (Dutch Chamber of Commerce no. 42017540), trading as Windowsites (“we”). “You” are a partner we have approved.

2. Applying and approval

We review every application and may decline one without giving a reason. You get a partner link, and requests count for you, only after approval.

3. When a customer counts for you

  • The business requests its preview website through your partner link (the code is in the link; we don't set a cookie for it).
  • The business isn't already our customer and hadn't used another partner's link before. The first partner link wins.
  • It isn't your own business, and you aren't the person who requested it.

4. Commission

You earn 33% of what the customer pays us, excluding sales tax and VAT, for their first 3 paid months. If the customer pays yearly, 3/12 of that yearly amount counts. Free months don't count. Different arrangements apply only if we agreed them in writing.

5. Hold period and refunds

A commission becomes payable 30 days after the customer's payment. If we refund a payment (in part) or it is charged back, the commission on that payment is canceled. If it was already paid to you, we deduct it from a later payout.

6. Payouts

We pay monthly by bank transfer once your payable balance is at least $50; a smaller balance rolls over. Add your bank details in your partner dashboard. US partners give us a W-9 before the first payout (we issue a 1099-NEC where required); partners outside the US give us a W-8BEN. You are responsible for your own taxes.

7. Rules for recommending us

  • No unsolicited commercial email, texts or calls that break the law (including CAN-SPAM and the TCPA), and no spam on any channel.
  • No search ads on our brand name (such as “Windowsites”), and no sites, accounts or ads that pretend to be us.
  • No promises we don't make about prices, results or Google rankings. Use what's on our site.
  • Disclose that you earn a commission when you recommend us, as the FTC requires (for example: “partner link”).

If you break these rules, we may end your participation immediately, and commission resulting from the violation is canceled.

8. Ending and changes

You and we can end your participation at any time. Commission on customers who came through your link before the end is paid under these terms, unless we ended it because of a violation. We may change these terms or the commission; we email you at least 30 days in advance, and changes only apply to customers who come in after that.

9. Other

You are not our employee or agent and can't make commitments on our behalf. Our liability is limited to the commission we paid you in the previous 12 months. These terms are governed by Dutch law. Questions? berend@bearsoftware.nl
